Dr. Hostin, a well-known orthopedic surgeon, is among nearly 200 individuals implicated in one of the largest RICO (Racketeer Influenced and Corrupt Organizations) lawsuits in New York’s history. He is facing grave accusations concerning federal insurance fraud, specifically alleged to have accepted kickbacks in return for performing unnecessary surgical procedures.
The Allegations of Fraud
As detailed in a lawsuit filed on December 17, 2023, Dr. Hostin is charged with engaging in deceptive practices by conducting surgeries, particularly arthroscopic procedures, and subsequently billing American Transit, a prominent insurance provider for taxi, Uber, and Lyft drivers. The lawsuit alleges that Dr. Hostin received illicit payments, which were misrepresented as “dividends” or other types of compensation for directing patients to specific medical facilities.
In response to these allegations, Hostin’s attorney, Daniel Thwaites, vehemently refutes the claims, characterizing the lawsuit as a “blanket, meritless” assault from a financially struggling insurance company. Thwaites contends that American Transit has not adequately investigated the allegations and is misusing the legal system to intimidate healthcare professionals. He further emphasized that Dr. Hostin’s professional reputation remains intact.

Sunny Hostin, aged 56, has been married to Dr. Emmanuel Hostin for over two decades. The couple, who exchanged vows in 1998, are the proud parents of two children and reside in an opulent home in Purchase, New York. American Transit has accused Dr. Hostin of receiving illegal kickbacks in return for referring patients to a surgical facility. The insurance company claims that Dr. Hostin performed unnecessary surgeries on accident victims who sustained only minor injuries, thereby breaching New York’s “No-Fault Law,” which is designed to cover medical expenses for individuals injured in accidents. The insurer argues that such fraudulent claims inflate premiums and negatively impact the public by destabilizing the insurance market for ride-share and taxi operators.
American Transit is seeking over $450 million in damages in this case, asserting that fraud is a widespread issue within New York’s insurance industry. The insurer contends that the misuse of the No-Fault Law has led to millions of dollars in improper payments, ultimately increasing insurance costs and raising premiums for responsible taxi and livery drivers.
